The rules that apply in Germany
Where your server sits decides which laws apply to it. Here is the short, factual version, as of September 2026.
- GDPR, plus the German BDSG and TDDDG — among the strictest data-protection regimes in Europe.
- The old data-retention law (TKG §§ 175–176) has been unenforced since 2017 and was held incompatible with EU law in 2022 and inapplicable in 2023.
- A new bill to make internet access providers keep IP-address assignments for three months is pending in the Bundestag as of September 2026.
- Good to know: the Federal Administrative Court ruled in 2018 that DE-CIX must assist the BND’s strategic surveillance of international traffic.
