Terms of Service

The rules that apply between you and us, written to be read: what we deliver, what you pay, and what happens if something goes wrong.

1. Who we are and what these terms cover

These Terms of Service (the “Terms”) govern the dedicated servers, network services, website and client area provided under the DediCrypto name (“DediCrypto”, “we”, “us”).

The following documents form part of these Terms: the Acceptable Use Policy, the Service Level Agreement, the Refund Policy and the Privacy Policy. By creating an account or placing an order you accept all of them.

2. Your account

  • An account needs an email address and a password. We do not ask for your name, postal address, phone number or any identity document, and we never will.
  • You must be legally able to enter into a contract in the country where you live.
  • You are responsible for keeping your credentials secret and for everything done with your account. We strongly recommend two-factor authentication.
  • Keep your email address working: it is where we send invoices, security alerts, maintenance notices and abuse complaints. Notices sent to it are considered received.
  • If you lose access to both your password and your email address, we cannot verify ownership by other means. Store your recovery codes safely.

3. Orders and delivery

An order becomes a contract when its first invoice is paid and the payment is confirmed on-chain. In-stock servers are normally delivered within 2–4 hours of that confirmation, and custom builds within 24–72 hours or by the date given in your quote.

If we cannot deliver an in-stock server within 72 hours, or a custom build within 72 hours of its quoted date, you may cancel the order for a full refund.

Each server is delivered with the hardware described on its order page and a delivery report produced on that machine. If the hardware does not match the description, tell us within 7 days: we replace it or refund you in full.

4. Prices and payment

  • Prices are set in US dollars per month. The price shown at checkout is the full price: we add no setup fee and no tax on top of it.
  • Invoices are paid in one of the cryptocurrencies listed on our crypto payments page. When you open an invoice, the coin amount is calculated at the current market rate and locked for 30 minutes.
  • If you send less than the invoice amount, the invoice stays open for the difference. If you send more, the excess is added to your prepaid balance.
  • A payment that arrives after the rate lock has expired is credited at the market rate at the time it confirms.
  • Blockchain network fees are paid by the sender. Payments sent to the wrong network or without a required memo or destination tag may not be recoverable; we will help where the funds can technically be recovered.
  • Quarterly and annual terms are fixed for their duration. On an active server we give at least 60 days of notice by email before any price change.

5. Renewals, suspension and deletion

We email the renewal invoice 7 days before the due date. If you keep a prepaid balance, renewals are paid from it automatically.

If a renewal is not paid by the due date, the server keeps running for a grace period of 3 days. It is then suspended (powered off, data untouched) and kept for 7 days, during which paying the invoice restores it as it was. After that, the server is reclaimed and its drives are securely erased. We cannot recover data after erasure.

6. Cancellation

You can cancel any service at any time from the client area or by ticket. By default the service runs until the end of the period already paid and is not renewed. You can also ask for immediate termination, in which case the drives are erased straight away.

Refunds for unused time, where applicable, follow the Refund Policy.

7. Your responsibilities

  • Use the services lawfully and in line with the Acceptable Use Policy.
  • Secure your server: operating-system updates, firewall rules, strong credentials and the software you install are your responsibility.
  • Keep your own backups. Unless you buy a service that says otherwise, we do not back up the data on your server, and RAID is not a backup.
  • Hold valid licences for the software you run, including Windows Server when installed from our template with your key.
  • Answer abuse complaints we forward to you within the time given in the notice.

8. Our responsibilities

  • Deliver the hardware you ordered and keep it running: failed disks are replaced within 2 hours and other parts within 4 hours, free of charge, as described in the SLA.
  • Operate the network to the availability target of the SLA and filter DDoS attacks at no extra cost.
  • Announce planned maintenance at least 48 hours in advance. Urgent security maintenance may be announced with shorter notice.
  • Never access the contents of your server unless you ask us to, for example during a repair you requested.

9. IP addresses

IP addresses assigned to your server remain allocated to us. You may use them for the life of the service, set their reverse DNS and point your domains at them, but you may not transfer them. They return to us when the service ends and are not reassigned to another customer for at least 30 days.

10. Service levels

Our commitments on network availability, hardware replacement and support response are set out in the Service Level Agreement, together with the service credits you receive if we miss them. Service credits are the sole financial remedy for unavailability.

11. Suspension for abuse or risk

We handle complaints with the due process described in the Acceptable Use Policy: we forward them to you and give you time to respond before acting. We only act without notice where there is an immediate risk — child sexual abuse material, an ongoing attack launched from your server, a compromise that endangers our network, or a binding legal order — and we tell you what happened as soon as we can.

12. Privacy and data requests

How we handle personal data is described in the Privacy Policy. We only disclose information in response to a valid legal order from a competent authority, we notify you unless the order legally prevents it, and we publish the number of such requests in our transparency report.

13. Liability

Apart from the commitments in the SLA, the services are provided as they are. To the extent the law allows, our total liability for any claim is limited to the fees you paid for the affected service in the three months before the event, and we are not liable for indirect losses such as lost profits, lost revenue or lost data.

Nothing in these Terms limits liability that cannot be limited by law.

14. Indemnity

You agree to cover the reasonable costs we incur because of a third-party claim arising from the content you host or the way you use the services in breach of these Terms or of the law.

15. Changes to these Terms

We may update these Terms. Material changes are emailed to you at least 30 days before they take effect, and you can cancel before then if you disagree. The version in force is always the one on this page, with its date at the top.

16. Governing law and disputes

These Terms are governed by the law of the country in which DediCrypto’s operating entity is established. Mandatory consumer-protection rules of the country where you live continue to apply where they give you more protection.
